1. Scope and mandatory rights
This policy applies to paid LEMIO subscriptions supplied by Express Buy OÜ. It does not exclude or reduce any mandatory right available to a consumer under Estonian or other applicable European Union law.
2. Cancelling renewal
Manual renewal requires no cancellation: the plan ends if the user does not purchase another period. Where automatic renewal is available, the user may cancel future renewal through the available account control or by sending an unequivocal request to info@lemio.ee before the next charge. Cancellation prevents future renewal charges but does not normally terminate the current paid period immediately.
3. Access after cancellation
Unless mandatory law, an approved refund or another legal remedy requires otherwise, the paid plan remains available until the end of the period already paid for. On expiry, the selected profile returns to the applicable FREE plan. Existing listings and photographs are not automatically deleted, although actions exceeding FREE limits may be restricted.
4. Consumer right of withdrawal
Where the customer is a consumer and the subscription is a distance contract for services, the consumer generally has 14 days from conclusion of the contract to withdraw without giving a reason. The request must be sent within that period. Statutory exceptions, extended periods caused by missing pre-contract information and other mandatory rules remain applicable.
5. Service started during the withdrawal period
LEMIO plan access normally starts after payment confirmation. If the consumer expressly requested performance to start during the withdrawal period and then withdraws, the consumer may be required by law to pay a proportionate amount for the service supplied before withdrawal. The withdrawal right may cease after full performance only where all statutory conditions, including the required prior express consent and acknowledgement, are satisfied. LEMIO will not rely on such a charge or loss of right where the required consent or information was not obtained.
6. Refund grounds
LEMIO reviews refund requests including:
- an erroneous or duplicate payment;
- a confirmed technical inability attributable to LEMIO to provide the paid plan for a material part of the paid period;
- withdrawal, termination, price reduction or reimbursement required by mandatory law.
A change of mind outside an applicable withdrawal right does not automatically create a refund, but this never limits mandatory remedies.
7. Request and evidence
A cancellation, withdrawal or refund request may be sent to info@lemio.ee and should identify the account, selected profile, order or payment reference, payment date and reason. A withdrawal statement need only be unequivocal; use of a particular form is not required. LEMIO may request information reasonably necessary to verify the requester, payment and claim without requesting unnecessary payment credentials.
8. Refund amount, method and timing
Where a refund is due, LEMIO refunds the amount required by law, taking account of any lawful proportionate charge for service already supplied. The refund is made through the original payment method unless the consumer expressly agrees to another lawful method without additional cost. For a statutory withdrawal, LEMIO initiates reimbursement without undue delay and no later than 14 days after receiving the withdrawal notice; the payment provider or bank may require additional time before the amount appears in the consumer's account.
9. Effect of refund and disputes
Where a full refund ends paid access, LEMIO may return the profile to the applicable FREE plan and update the related order. Physical deletion of listings or photographs is not an automatic consequence. If a matter is not resolved directly, the consumer may use the competent consumer dispute body or courts available under applicable law.
10. Listing bump purchases
A listing bump is a separately purchased digital service applied after successful payment. Refund and withdrawal requests concerning a bump are assessed under this policy and mandatory law, taking account of whether the user expressly requested immediate performance and whether the bump was already applied. A failed or cancelled payment does not apply a bump. Nothing in this section limits remedies for an erroneous or duplicate charge or a technical failure attributable to LEMIO.
